2 years on, Farah murder case yet to be probed

KABULinfo-icon (Pajhwok): Abdul Jabar, brother of Wolesi Jirgainfo-icon member Abdul Satar, a resident of western Farah, killed his nephew Mohammad Hussain two years ago, but he is yet to be arrested or prosecuted.

The case is yet to be probed while Hussain’s brother was kidnapped and murdered, said father of the victims, Mohammad Naeem Hussaini, a resident of Darabad village in Farah City.

He told Pajhwok Afghan News his brother Abdul Jabar Hussaini killed his son (Mohammad Hussain Hussaini) on November 20, 2018.

The father said: “Everyone knows that Abdul Jabar and Abdul Satar are powerful, all people of Farah know =my son was killed after a verbal clash over the parliamentary election.”

He said his son worked for about seven years as crime branch officer at Farah, but after falling ill, he left his job and wanted to go to India for treatment.

Shortly after his son Hussain was killed, his second son (Mohsen), an employee of the Farah Passport department, was also killed by unknown gunmen after being abducted. He added he had no idea whether his second son was killed by militants or someone else.

The father complained that both the murder cases had not yet been investigated by the authorities.

Naeem claimed that Hussain’s murder (his first son) was not investigated by security and judicial organs due to pressure from Abdul JabbarHussaini, who was local police commander, and ‘possibly’ with the help of Abdul Satar.


Pajhwok obtained a copy of the verdict dated 9th January, 2019, of the appellant court of Farah province in connection with the certain case, according to which Abdul Jabar Hussaini has been declared to be under prosecution; but he has not been arrested for nearly two years.

The verdict says after investigations, the court found there was some dispute between Mohammad Hussain and his uncles Abdul Jabar and Abdul Sattar in the past.

It said Abdul Jabbar, the prime accused, after a meeting of local influential elders in a mosqueinfo-icon in Darabad village, detained Mohammad Hussain, and Mohammad Asif and Amir Jan, two other men on accusations of robbery and other crimes.

Jabar along with his other armed men ordered tying Hussain’s hands and feet but Hussain took a weapon from Abdul Ahmad (armed man who is also accused in the murder) for his own defense and injured Abdul Ahmad and Nasir Ahmad, the source said.

It added that Abdul Jabar, then opened fire at Mohammad Hussain and killed him.

Jabar and his accomplices after committing the murder called a kangaroo court, the verdict said, adding that Mohsen, son of Mohammad Naeem, then lodged a complaint that Mohammad Hussain was killed on the order of Abdul Sattar, brother of Abdul Jabar.

“But the attorney office did not carry out any processes and stopped everything only by summoning the (accused), the office should have arrested the accused through relevant organs,” the verdict stated.

It said the attorney office convicted three persons, Abdul Ahmad, Nasir Ahmad and Baz Mohammad in a mistaken murder. “But their action will be considered intentional because they used a weapon and Abdul Jabar shot the victim in the head even after his death.”

The appellate court, about the case, declared Abdul Ahmad, Nasir Ahmad and Baz Mohammad as innocent in the murder case due to lack of evidence, but Abdul Ahmad was fined 60,000 afghanis cash for carrying an unlicensed weapon.

Abdul Jabbar is under prosecution in the murder case of Mohammad Hussain and Mohammad Asif and Amir Khan are also under prosecution for looting the house of Zahir Shah, the court’s verdict said.

At the end, the document carries signatures of judge SikandarMazhari, head of the judicial bench, judge Abdul Rahim Adib and judge GulRahmanAmiri --- the bench members.

Abdul SattarHussaini, a lawmaker from Farah province, said: “Mohammad Hussain was my nephew and eldest son of my brother and the one accused is my brother. This is a family dispute that erupted as a result of a verbal clash between uncle and nephews.”

Referring to Mohsen who was kidnapped and murdered, he said: “My nephew Muhsen was murdered on the first day of Eid by Haji Abbas, Talibaninfo-icon’s shadow chief for Balaboluk district. Not only Mohsen, but the Taliban have killed my 31 family members in the past few years.”

Pajhwok also shared this matter with Rasouli two days earlier but he did not respond.

Views of local residents

A resident of Daarabad village in Farah City whishing not to be named said that Policeman Mohammad Hussain along with his other colleague had been arrested by his uncle Abdul Jabbar over alleged robbery and Abdul Jabbar shifted the detained individuals to village Eidgah Masjid in order to decide their fate.

According to the source, in Eidgah Masjid, Hussain Naam got access to a weapon and opened fire on his uncle and as result, three people including Abdul Jabar got injured.

Hussain after firing on his uncle fled the scene but Abdul Jabar in return opened fire on Hussain and killed him.

According to the resident, the dispute among Hussaini brothers is resolved and currently there is no dispute among them.

Conspiracy is hitched against me: Abdul Sattar

Wolesi Jirga Member Abdul Sattar Hussaini claimed that the matter was shared with media after two years because National Security Advisor Hamdullah Mohib through this way wanted to silence his voice for justice.

He did not provide details regarding the case, but added that Mohib by fueling tensions related to Hussain’s murder wanted to erupt war among families of Hussaini.

“I am answerable to the law and since 2003 I have worked on different government positions, I am responsible for everything I had done,” he said.

Mohammad Naeem victim’s father said: “Nothing can heal my wounds after two years of the incident. In these days ties between Abdul Sattar Hussaini and Mobib are tense and Mohib wants to conspire. I don’t accept conspiracies which will provide an opportunity for every criminal. Abdul SattarHussaini is my brother and I will support him.”

Denial of Abdul Sattar’s claim

RahmatullahAndar, spokesperson for the National Security Council, rejected Abdul SattarHussain’s allegation regarding Mohib’s interference in this case and added Dr. Mohib and the NSC has no link with the issue and if Hussaini has any evidence in this regard he could share with the nation.

Without going into details, Andar said: “A number of Wolesi Jirga members without any doubt are involved in murders and smuggling, but never Mobib confronted any member of the house.”
